In a 2025 decision, India’s Supreme Court backed a land buyer after a seller concealed an existing mortgage during the transaction. The court held that when property encumbrances are fraudulently hidden, the buyer is entitled to a full refund of the deposit. The ruling reinforces that prospective buyers must verify title and mortgage status before paying or registering.
